Ask the insurance expert

Crashed into an old banger?

Wednesday, 24 Sep 2008 14:15
A reader has had a bump with a car already a bit worse the wear. She is worried the other drive may try can claim for more damage than was caused.

Ian Durrell, myfinances.co.uk insurance expert from the Only Group, which includes onlyinsurance.com, tackles the issue.

Rhonda asks

I tapped someone on the bumper with my car (rolled from a complete stop) and their vehicle already has substantial damage.

Does their insurance company need to prove that I caused the damage they are claiming before I have to pay for anything?

I took photos at the site of both cars, there is no paint transfer or corresponding marks on my car.

Ian replies:

It does seem that they will need to make an effort to prove the damage being claimed for.

With pictures etc, I don’t think they will be able to push it too far.
