Getting an ex off your mortgage?

A reader from London wants to take her ex's name of their joint mortgage, but is unsure about the best step forward.

Tony Davis, myfinances.co.uk mortgage expert from Mortgage Meadow, takes her through the problem and what it means to her finances.

A reader asks:

I have signed deeds to a property which the other party has contributed nothing to over the past 23 years.

I want his name off the deeds - where do I stand?


Tony replies:

From a mortgage point of view, unless he agrees to remove his name from the deeds you will have to take him to court and obtain a court order to do so.

As such, your starting point to take legal advice. Although he may not have paid the mortgage directly, he could argue that he has supported the household financially in other ways, contributing towards its up keep and is therefore entitled to keep his equity.
