Getting a lost ex off your mortgage?

Monday, 25 Feb 2008 17:32
A reader is trying to take her ex-partner off her mortgage, but they have lost contact.

Ronan Marrion, mortgage specialist at Worldwide Financial Planning, part of our team of Independent Financial Advisers (IFAs) from unbiased.co.uk, offers a helping hand.

Alison from Leicester asks:

How would I get my ex-partner off the mortgage if he cannot be found?

Ronan from Worldwide Financial Planning responds:

This is a tricky one.

This is very dependent on how long your ex-partner has been AWOL.

Through your solicitor you will have to apply to your county court to get the ex, he would be known as the 'absent trustee', removed. The court will want to see evidence that extreme effort has been made to make contact with the individual and this will be a lengthy process as the court may have various things to consider, i.e. if there was an increase in the value of the property what is he entitled to.
