Do I have a claim to my ex's pension?

Thursday, 09 April 2009 05:09

A reader from London wonders if she is entitled to part of her ex-husbands pension.

Andrew Norton, Halifax investments expert, tackles the problem.

Irene from London asks:

Can I claim my ex-husband's pension? I divorced my husband in 1992.

Am I entitled to any of his pension that we both paid into while we were married?

Andrew replies

You are unlikely to be entitled to any part of your ex-husband's pension because provisions of this nature became available after your divorce in 1992.

The pension should have been taken into account as part of the overall marital split of assets.

Check with your legal adviser if unsure.
